- Making a purchase in the restaurant or online by using our websites or mobile applications; • Creating a profile or account on our websites or mobile applications;
- Signing up for our marketing communications or participating in a promotion, such as a sweepstakes or contest;
- Posting a review or commenting on one of our social media pages or other monitored website;
- Requesting customer service or contacting us to resolve a dispute; and
- Visiting and using features on our websites, waitlist, text to-go, or on our mobile applications.
TYPES OF INFORMATION WE COLLECT FROM YOU
The personal information, over the last 12 months, that we may have collected from you includes:
When you sign up for an account as part of our email marketing, text marketing, or to create a profile for online services, such as the waitlist or online ordering, you must provide certain information to us. The required information includes your name, email address, zip code, and birthdate. Optionally, you may provide information regarding your phone number and whether
you have children under the age of 12. In addition, your account will maintain a purchase history, allow you to make purchases, record your location (with your consent), and allow you to choose your preferred restaurant location.
Online Payment Information
You must provide us with payment information, including your credit or debit card number, card expiration date, CVV code, and billing address, to make online purchases of goods and services, such as food and gift cards.
Online Gift Card Purchases
You may choose to purchase physical or electronic gift cards on our websites or mobile applications. To do so, you must provide certain information including your name, email address, telephone number, physical address, payment information, and (for electronic gift cards) the name and email address of the person receiving the gift card.
You can get on a waitlist before you visit a RESTAURANT NAME or RESTAURANT NAME location. You can join the waitlist by phone, online or by using the relevant mobile application. When using the waitlist functions online, you can use your account to get on the waitlist or you can register as a guest. If you register as a guest, you must provide your name, phone number, party size, whether you need a high chair, and your email address. You may also get on the waitlist by calling a RESTAURANT NAME or RESTAURANT NAME location. If you call a RESTAURANT NAME or RESTAURANT NAME location, you may be asked to provide your name, party size, and if you have any special requests.
You may choose to sign up for marketing communications from us. This can occur through several methods, including when you create an account with us, sign up online, participate in a survey, by paper form, or placing an online order. Certain information may be collected during this process, including your name, email address, birthdate, and favorite location. You may choose to provide your phone number and disclose whether you have children under the age of 12.
Communications with Us
You may choose to communicate with RESTAURANT NAME by email, web form or phone. In those cases, the information you provide will depend upon the purpose of your inquiry, but could include your name, email address, physical address, payment information, tax identification number, and medical information.
If you participate or win a contest sponsored by RESTAURANT NAME, you may need to provide your contact information, tax ID information, or other information required by law.
You may be offered the opportunity to participate in a survey following a purchase. If you choose to participate, you may be asked to provide personal information, including your name, email address, gender, physical address, phone number, information about your purchase or purchase history, information about your experience, household income, household size, race, or ethnicity.
Your image may be stored in surveillance footage at our restaurants. We use cameras in our restaurants for security, operational, and compliance purposes.
We monitor public internet postings for communications relevant to our brand. We may choose to respond to these postings and keep a copy of the postings.
You may provide information passively, though the use of technology when you visit our website or use our mobile application. Some of this information might be able to be linked to you. This information helps our website and mobile application work and support our marketing and analytics efforts. This information includes information about your Internet Protocol (IP) address, the type of device you are using, the operating system you are using, the address of referring websites, and the path you take in our website.
Cookies and similar technology; “Do not track” signals
There is a technology called “cookies” which can be used to provide you with tailored information from a website. A cookie is an element of data that frequently contains an anonymous unique identifier; the data is sent from our website to your web browser, which may then store it on your system for future use. HOW WE SHARE INFORMATION WITH FRANCHISEES
RESTAURANT NAME provides services related to email marketing, text marketing, and its mobile application to Franchisees. The data related to these services is owned by RESTAURANT NAME and not the Franchisees.
We share certain aggregated data with our Franchisees related to your association with their restaurants and how that data compares to similar data in other restaurants.
In addition, though the Franchisees do not have access to view your personal information in our VIP Club, they may send marketing messages to you via a distribution list.
If you use the waitlist function on our website or mobile application, your information will be provided to the Franchisee to complete your request.
WE SHARE YOUR INFORMATION TO COMPLY WITH LEGAL OBLIGATIONS

In the event of a transfer of all or substantially all of RESTAURANT NAME’s assets to a third party, we reserve the right to transfer your personal information and usage data to the third party. CHILDREN’S PERSONAL INFORMATION

MOBILE MARKETING MESSAGES
If you are currently receiving text messages from us, you may tell us to stop sending them by using the opt-out functionality in the next marketing text message you receive. You can also opt-out at any time by texting “STOP” to 68984. After we receive your opt-out, we will send you a final text message to confirm the opt-out.

THE RIGHT TO KNOW ABOUT PERSONAL INFORMATION COLLECTED, DISCLOSED OR SOLD

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. You may designate an authorized agent to make a request on your behalf by registering such person or entity with the California Secretary of State.
HOW OFTEN CAN YOU SUBMIT A VERIFIABLE REQUEST?
You may only make a verifiable consumer request for access or data portability twice within a 12-month period.
HOW TO SUBMIT A VERIFIABLE REQUEST?

Provide your full name, phone number, email address, state of residence and the type of request you are making.
We must verify your identity and authority to make a request before we provide you with personal information. For certain requests, RESTAURANT NAME will notify you if we need additional information to verify your request.
We will send you an email acknowledging that we received your request. You must reply to the email and affirm that you made the request.
We will use the data provided by the consumer to process the request.
We will respond within 45 days of your initial request. If necessary, RESTAURANT NAME may take an additional 45 days to respond to your request.
HOW RESTAURANT NAME VERIFIES AND RESPONDS TO REQUESTS
Your request must be verifiable. That means that you, or your authorized representative, must provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or an authorized representative of that person. For example, if you are requesting access to or information about specific pieces of information, then we will require you to submit a signed declaration under penalty of perjury.
